Terms of Service

1. Acceptance of Terms

By accessing or using Checksum services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Checksum provides tools for detecting and managing your online presence, including facial recognition and content detection services. Our services are designed to help you control where your face and content appear online.

3. User Accounts

You are responsible for maintaining the confidentiality of your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.

4. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.

5. Acceptable Use

You agree not to use our services for any illegal or unauthorized purpose. You must not violate any laws in your jurisdiction, including copyright or trademark laws.

6. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the service with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms of Service.

8. Limitation of Liability

In no event shall Checksum, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any use or inability to use our services.

9. Governing Law

These Terms shall be governed by the laws of the United States and the State of California, without respect to its conflict of laws principles.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of any material changes to the Terms by posting the new Terms on our website.

11. Your Right to Be Forgotten

In accordance with privacy regulations like GDPR and CCPA, you have the right to request deletion of your personal data. Upon such request, we will:

  • Delete all your personal information from our active systems within 30 days
  • Remove your data from our backups during our regular backup rotation (maximum 90 days)
  • Provide written confirmation once your data has been completely removed
  • Ensure third-party service providers also delete your data

To exercise this right, please email privacy@checksum.media with the subject line "Right to be Forgotten Request."

12. Plain Language Commitment

We commit to communicating with you in clear, understandable language. This means:

  • Our Terms of Service and Privacy Policy are written to be understood by non-lawyers
  • Important changes to our policies will be highlighted and explained in simple terms
  • We will provide summaries of key points alongside our full legal documents
  • When we update our policies, we will provide a change log that clearly identifies what has been modified

13. Data Breach Notification Commitment

In the event of a data breach affecting your personal information, we commit to:

  • Notifying you within 72 hours of discovering the breach
  • Providing specific details about what information was compromised
  • Explaining the steps we're taking to address the breach
  • Offering guidance on how you can protect yourself
  • Providing credit monitoring services at our expense if financial or highly sensitive information is compromised

This commitment exceeds the legal requirements in many jurisdictions and reflects our dedication to transparency and user protection.

14. Responsible Disclosure Policy

We value the work of security researchers in improving the security of our services. If you discover a vulnerability in our systems:

  • We will not take legal action against you if you follow our responsible disclosure guidelines
  • We commit to acknowledging your report within 48 hours
  • We will keep you informed about our progress in addressing the vulnerability
  • With your permission, we will publicly acknowledge your contribution once the vulnerability is fixed
  • We offer a bug bounty program to reward responsible disclosures

15. User Ownership of Content

You retain full ownership of any content you upload to our service. Specifically:

  • We claim no intellectual property rights over your content
  • We will never use your content for marketing or promotional purposes without explicit consent
  • You can export and delete your content at any time
  • If we cease operations, we will provide at least 90 days' notice and tools to export your data

Lawful Order Transparency

As of 2025-06-04, Checksum Media, Inc. has:

  • Never received a National Security Letter
  • Never received a FISA court order
  • Never received any government subpoena
  • Never been subject to any gag order by a FISA court
  • Never been subject to any other similar court order
  • Never placed any backdoors in our software or systems
  • Never received any request to do so
  • Never been subject to any government-imposed gag order

This statement will be updated regularly. If this statement is not updated for a period exceeding 3 months, it may indicate that we have received a legal order that we are prohibited from disclosing.
